The Chain of Responsibility

The Chain of Responsibility extends heavy vehicle road safety to parties other than drivers. It captures everyone who works with heavy vehicles or is accountable for the safety of the vehicle, its driver and its load. Importantly, being a party is based on the function you perform, not your job title or the wording of a contract.

  • Schedulers of transport or of a driver's work and rest hours
  • Consignors and consignees of goods
  • Packers and loaders
  • Loading managers and operators
  • Executives with a due diligence duty
Category 1 (most serious)Individuals can face fines exceeding $377,000 or up to 5 years imprisonment
Primary dutyA breach of the primary duty is the most serious contravention of the HVNL
